Terms and Conditions of ADITUS GmbH for the Purchase of Tickets via the Ticket Shop
ADITUS GmbH (Straße der Nationen 5, 30539 Hanover, Germany, registered with the Commercial Register of the Local Court of Hanover; hereinafter referred to as “ADITUS”) acts as the ticket seller and contractual partner of the purchaser for the events presented on this platform.
The execution of the event, event-related communication and the organizer’s own event purposes remain the responsibility of the respective event organizer. BREKO Servicegesellschaft mbH (hereinafter referred to as “BREKO”) remains responsible for these areas. By purchasing a ticket, customers also enter into a contractual relationship with the event organizer. Preamble
These Terms and Conditions govern the sale of tickets for events via the online ticket shop of ADITUS GmbH to customers.
1. Scope of Application
These Terms and Conditions apply to all contracts regarding the purchase of tickets and the redemption of vouchers concluded via the online ticket shop of ADITUS GmbH.
The version of the Terms and Conditions valid at the time of conclusion of the contract shall apply.
By completing the order process, the customer accepts these Terms and Conditions as the basis of the contractual relationship.
Any conflicting terms and conditions of the customer shall not apply unless their applicability has been expressly agreed to.
2. Conclusion of Contract
By completing the ordering process, the customer submits a binding offer to purchase the selected tickets.
The contract is concluded when ADITUS accepts the customer's order. Acceptance is generally effected by sending an order confirmation by email or by providing the purchased tickets.
3. Delivery and Provision of Tickets
Following successful completion of the order, the purchased tickets will be provided to the customer in digital form. Tickets are generally delivered by email or made available through the customer account in the ticket shop.
The customer is obliged to check the received tickets immediately for completeness and accuracy of the information contained therein and to notify ADITUS without undue delay of any errors.
The possibilities of cancellation, return or reimbursement of tickets are governed by applicable law and these Terms and Conditions.
4. Personalisation and Transfer of Tickets
Where tickets for an event are personalized, registration is required for the purchase and use of such tickets. The customer is obliged to provide complete and accurate information for this purpose.
Personalized tickets may only be used by the registered person unless otherwise specified in event-specific regulations.
The reproduction, manipulation or misuse of tickets is prohibited.
Any commercial or unauthorized resale of tickets is prohibited.
Tickets that have been altered, duplicated, manipulated or transferred in violation of these Terms and Conditions do not entitle the holder to admission to the event.
ADITUS reserves the right to block such tickets and deny admission to the event. Any further statutory rights remain unaffected.
5. Exclusion of the Right of Withdrawal
No right of withdrawal applies.
Pursuant to Section 312g (2) No. 9 of the German Civil Code (BGB), there is no right of withdrawal for contracts relating to services connected with leisure activities if the contract provides for a specific date or period of performance.
As the tickets offered by ADITUS entitle the holder to attend an event taking place on a specific date, the statutory right of withdrawal is excluded.
Statutory rights of the customer, in particular in the event of cancellation or substantial modification of the event, remain unaffected.
6. Data Protection
In the course of ticket sales, ADITUS GmbH processes personal data in compliance with the applicable data protection laws.

7. Changes, Postponement or Cancellation of the Event
The execution of the event is the sole responsibility of the respective event organizer.
The organizer reserves the right to modify, postpone or cancel the event for legitimate reasons where necessary.
In the event of cancellation or substantial modification of the event, the organizer will, where possible, inform affected customers without undue delay.
Any claims of the customer arising from the cancellation, postponement or substantial modification of the event shall be governed by applicable law and the regulations of the respective organizer.
Where the customer is entitled to a refund of the ticket price in an individual case, reimbursement shall be processed through ADITUS as the ticket seller.
8. Liability
ADITUS shall be liable without limitation for damages caused by intentional misconduct or gross negligence on the part of ADITUS, its legal representatives or agents.
In cases of slightly negligent breaches of essential contractual obligations (cardinal obligations), ADITUS’ liability shall be limited to the foreseeable damage typical for the contract at the time of its conclusion. Essential contractual obligations are obligations whose fulfilment is necessary for the proper performance of the contract and on whose compliance the customer may regularly rely.
The foregoing limitations of liability shall not apply in the event of injury to life, body or health, liability under the German Product Liability Act, or where liability is mandatory by law.
Otherwise, ADITUS' liability shall be excluded to the extent permitted by law.
ADITUS strives to ensure that the ticket shop is available without interruption whenever possible. However, uninterrupted and continuous availability cannot be guaranteed due to technical circumstances.
9. Prices and Payment Terms
The prices displayed in the ticket shop at the time of the order shall apply. All prices include the applicable statutory VAT unless expressly stated otherwise.
The purchase price is due immediately upon conclusion of the contract.
Payment may be made using the payment methods offered in the ticket shop, including credit card (VISA, Mastercard) and WERO.
The invoice is generally provided to the customer as a PDF document together with the order confirmation by email.
If a payment is reversed, charged back or otherwise not successfully processed by the payment service provider, ADITUS shall be entitled to block the affected tickets until the payment process has been fully clarified.

10. Dispute Resolution
ADITUS is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
11. Final Provisions
Should any provision of these Terms and Conditions be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
The statutory provisions shall apply in place of the invalid provision.
The laws of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
If the customer is a consumer and has their habitual residence in another Member State of the European Union, mandatory consumer protection provisions of that state shall remain unaffected.
In the event of discrepancies between different language versions of these Terms and Conditions, the German version shall prevail.
