Terms and Conditions

E-world energy & water GmbH is the organiser of the event and therefore the issuer of the admission tickets (tickets). After purchasing a ticket, contractual relations regarding attendance at the event are established exclusively between the purchaser of the ticket (the customer) and E-world energy & water GmbH. The organiser's General Terms and Conditions (GTC) set out below apply to these legal relationships. By ordering tickets, the customer instructs E-world energy & water GmbH (the organiser) to process the ticket purchase, including shipping.

I. Application

  1. These General Terms and Conditions apply exclusively to the legal relationship between the purchaser and E-world energy & water GmbH for all contracts and orders placed for the purchase of tickets for the event.
  2. The buyer's general terms and conditions do not apply.

II. Conclusion of the contract, cancellation

  1. An offer to conclude the contract is made by the customer when clicking on the 'Order now' button. The contract between the customer and the organiser comes into effect when E-world energy & water GmbH allocates and sends the transaction number to the customer.
  2. The organiser accepts no liability for the accuracy of the information on the event's website.
  3. E-world energy & water GmbH may cancel orders placed by the customer for which order confirmation has already been issued (unilateral right of withdrawal), if the customer breaches specific conditions set by E-world energy & water GmbH which were highlighted during the advance ticket sales process or attempts to circumvent them (e.g. breaching the limit on the number of tickets per customer, breaching the terms and conditions of the ticket, especially the prohibition on resale, attempting to circumvent these conditions by registering and using multiple user profiles, etc.). Notice of cancellation or withdrawal may also be implied by refunding amounts paid. This right of withdrawal is governed by §§ 346 et seq. BGB, to the exclusion of § 350 BGB.

III. Prices & payment terms

  1. Ticket prices may exceed the face value printed on the tickets. Customers can pay by credit card or PayPal. Statutory VAT is included in the price.
  2. The total price of the order, including all charges, is payable immediately upon conclusion of the contract.

IV. Limitations on liability; exclusion of the right to withdraw in the event of certain breaches of duty

  1. E-world energy & water GmbH shall, in all cases, bear unlimited liability under the German Product Liability Act for damage caused intentionally or through gross negligence, in the event of fraudulent concealment of defects, and for damage resulting from injury to life, limb or health. Liability for damages arising from a breach of warranty is also unlimited.
  2. In the event of a breach of material contractual obligations arising solely from simple negligence, E-world energy & water GmbH shall be liable only for compensation for the foreseeable loss typical of the contract.
  3. Except in the cases referred to in paragraphs 1 and 2, E-world energy & water GmbH shall not be liable for damage caused by ordinary negligence.
  4. The customer may not withdraw from the contract on the grounds of a breach of obligation for which E-world energy & water GmbH is not responsible and which does not constitute a defect in the goods.
  5. Where the liability of E-world energy & water GmbH is excluded or limited in accordance with the preceding paragraphs, this shall also apply to the liability of its agents and vicarious agents.

V. Cancellation and postponement of the event

  1. The organiser reserves the right to cancel or postpone the event, or any part thereof, at its own discretion. In the event that the event is cancelled without good cause or due to force majeure, the organiser's liability is limited to the amount already paid by the customer for the ticket. Should the event be postponed, the customer may attend the event on the new date using the ticket; the customer shall have no further claims.
  2. The organiser may especially postpone or cancel the event in case of force majeure, especially natural disasters, pandemics or epidemics. In case of force majeure, the customer has no claims whatsoever.

VI. Final provisions

  1. Should any provisions of these General Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions of these General Terms and Conditions. In such case, the invalid provision shall be replaced by a valid provision that most closely reflect the economic purpose of the invalid provision.
  2. The law of the Federal Republic of Germany shall apply exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
  3. The sole place of performance for delivery, services and payment is Essen, provided that the customer is an entrepreneur within the meaning of § 14 BGB.
  4. If the customer is a merchant, the exclusive (including international) place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship is Essen. In case of cross-border contracts, this also applies to non-merchants. E-world energy & water GmbH reserves the right to bring proceedings before any other court with international jurisdiction.
